1. Acceptance of Terms

By accessing or using QRlytics ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

QRlytics is a service operated by Z-AGENCY s.r.o., a company registered in the Czech Republic. For company registration details, please contact us at info@processgate.ai.

2. Description of Service

QRlytics provides a platform for creating trackable QR codes and viewing scan analytics. The Service includes:

QR code generation for various content types (URLs, text, vCards, WiFi, email)
QR code customization (colors, design)
Scan tracking and analytics
Short URL redirection
Dashboard and reporting

2.1 Platform Availability

QRlytics is available as a web application (qrlytics.eu) and as a mobile application (iOS and Android). The web application is the primary platform and provides the full range of features. The mobile application provides core functionality optimized for mobile use, but not all features are available on mobile.

Features available exclusively on the web platform include, but are not limited to:

REST API access and API key management (VIP plans)
Webhook configuration for scan notifications (VIP plans)
Per-QR code custom branding (VIP plans)
VIP plan purchases and management
CSV/data export of analytics
Advanced QR code types (vCard, WiFi, email)
Blog and content resources

The mobile application is designed for convenient QR code creation and scan monitoring on the go. For the complete feature set, we recommend using the web application. We reserve the right to change which features are available on each platform at any time.

3. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

3.1 Mobile Authentication

You may register using email/password, Apple Sign In (iOS), or Google Sign In. When using third-party authentication, you are also subject to Apple's and Google's respective terms of service. We recommend reviewing their privacy practices before using these sign-in methods.

4. Subscription Plans

4.1 Free Plan

The Free plan includes up to 10 QR codes per month with basic scan tracking and 30 days of analytics history.

4.2 Pro Plan

The Pro plan includes unlimited QR codes, full analytics with country and device data, logo embedding, and CSV export functionality.

4.3 VIP Plans

VIP plans include everything in Pro, plus REST API access, webhook notifications, per-QR branding, and additional features. VIP plans can only be purchased and managed through the web application (qrlytics.eu). VIP features such as API access, webhook configuration, and per-QR branding are not available in the mobile application.

VIP Starter ($15/month): 1,000 API calls/month, custom branding, priority support
VIP Business ($39/month): 10,000 API calls/month, dedicated support
VIP Enterprise ($99/month): 100,000 API calls/month, enterprise support

API usage is tracked monthly. Exceeding your plan's API call limit will result in requests being rate-limited until the next billing cycle.

4.4 Billing

Subscriptions are billed monthly or annually. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

4.5 In-App Purchases (Mobile)

Subscriptions purchased through our mobile application are subject to the following:

All purchases are processed through Apple App Store or Google Play Store
Refund requests must be made through the respective app store, not directly to us
To cancel: iOS - Settings → Apple ID → Subscriptions; Android - Google Play → Subscriptions
Subscription prices may vary by region due to app store pricing policies

5. Acceptable Use

You agree not to use the Service to:

Create QR codes linking to illegal content
Distribute malware, phishing, or fraudulent content
Infringe on intellectual property rights
Harass, abuse, or harm others
Send spam or unsolicited communications
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service
Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The Service, including its design, features, and content, is owned by Z-AGENCY s.r.o. and protected by intellectual property laws. You retain ownership of the content you upload to create QR codes. By using the Service, you grant us a license to process and display your content as necessary to provide the Service.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Internet & Mobile Requirements

8.1 Internet Connectivity

The Service requires an active internet connection (Wi-Fi or mobile data) to function. Z-AGENCY s.r.o. is not responsible for the Service not being available at full functionality if you do not have access to an internet connection.

8.2 Mobile Data Charges

If you use the Service outside of a Wi-Fi area, your mobile network provider's terms and charges will apply, including roaming data charges if you use the Service outside your home territory. You are responsible for any such charges. If you are not the bill payer for the device on which you use the Service, we assume you have received permission from the bill payer to do so.

8.3 Device Compatibility & Updates

Z-AGENCY s.r.o. does not guarantee that the Service will be compatible with all devices, operating systems, or browsers. You are responsible for ensuring your device meets the minimum system requirements. Additionally:

We may release updates that you will need to download to continue using the Service
System requirements may change over time, and you agree to accept updates when offered
We do not promise to always update the Service to remain compatible with older operating systems or devices
Z-AGENCY s.r.o. is not responsible for technical issues related to your device, including battery status, custom hardware or software modifications, or insufficient storage

9. Service Availability

We strive for high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. We may perform maintenance that temporarily affects availability, and we will provide reasonable notice for scheduled maintenance when possible.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Z-AGENCY s.r.o. does not warrant that:

The Service will meet all your specific requirements
The Service will be uninterrupted, timely, secure, or error-free
The results obtained from the Service will be accurate or reliable
Any errors in the Service will be corrected

The Service relies on third-party services and infrastructure (including but not limited to hosting providers, payment processors, geolocation services, and email delivery services). Z-AGENCY s.r.o. is not responsible for the availability, accuracy, or performance of these third-party services, and any failures or interruptions caused by third-party services are beyond our control.

Z-AGENCY s.r.o. is not responsible for issues arising from your device, operating system compatibility, battery status, custom hardware or software modifications, internet connection quality, or mobile network provider limitations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Z-AGENCY S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Z-AGENCY s.r.o. shall not be responsible for any damage or loss resulting from:

Technical issues related to your device, service provider, or data connection quality
Inability to use the Service due to lack of internet connectivity or insufficient battery
Failures, outages, or interruptions of third-party services we rely upon
Your failure to keep your device and application up to date
Unauthorized access to your account due to your failure to maintain credential security

12. Indemnification

You agree to indemnify and hold harmless Z-AGENCY s.r.o. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and your QR codes will stop functioning.

14.1 Account Deletion

You may delete your account via Settings → Profile → Delete Account (mobile app) or Settings → Account → Delete Account (web). Upon deletion:

All your QR codes will be deactivated immediately and stop redirecting
Your personal data will be permanently deleted within 30 days
Active subscriptions will be canceled without refund for remaining period
Scan analytics data associated with your QR codes will be anonymized
This action cannot be undone

15. Governing Law

These Terms shall be governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of Prague, Czech Republic, unless you are a consumer entitled to bring proceedings in your local courts under applicable law.
